What we agree on when you use the HearCloselyKeys app and take a subscription.

  • Who we are and what these terms cover

    HearCloselyKeys is a desktop app that turns a MIDI file into a video of a piano with notes. It is made by the HearClosely project. These terms cover the app, this site and the subscription. By using the app or the site you agree to them; if you do not agree, do not use them.

  • The app remains ours

    We give you the right to use the app on the terms described here; the app itself, its code, its name and its mark remain ours. You cannot sell this right or pass it on to another person.

  • The free plan

    You can use the app for free and without signing in. A video made on the free plan carries the HearCloselyKeys mark and is up to 3 minutes long. What exactly the free plan includes is stated on the “Plans” page; we may change it, and new features may appear only in the subscription.

  • Subscription

    A subscription takes the mark off and removes the length limit. The prices are on the “Plans” page; the tax of your country may be added, and the amount may be shown in your currency - you see the exact amount before you pay. The subscription starts at once after payment and renews by itself for the same term until you cancel it. It can be taken by an adult, or by someone whose parents have allowed it.

  • Who takes the payment

    Orders are processed by Paddle.com, our reseller. Paddle takes the payment, issues the invoice and makes refunds; its name will be on your bank statement. We do not see or store your card. Paddle's own terms for buyers also apply to the purchase; you can see them in the payment window.

  • If a payment fails

    If a renewal payment fails, Paddle will try again, and until it is paid the plan is free: new videos carry the mark again. As soon as the payment goes through, the subscription comes back by itself.

  • How to cancel

    You can cancel the subscription at any time on the account page, with the “Manage subscription” button. After that it stays active until the end of the term you have paid for and does not renew.

  • Refunds

    We do not refund subscription payments: you can try the app on the free plan and make sure it suits you before you pay. Payments made by mistake are refunded. The details are on the “Refunds” page, which is part of these terms.

  • Account and computers

    A subscription belongs to one person. The app can be linked to two computers at a time; you can remove a computer to free a place three times a year. You may not pass the account or the licence on to other people. You are responsible for what happens in your account - keep your Google sign-in safe.

  • The internet

    You can make videos without the internet. It is needed to sign in to your account, and from time to time for the app to renew its licence. After the first payment the app has to connect to the site once more within two weeks; after that, with a yearly subscription, it works without the internet until the end of the paid term. If the app has not connected to the site within those two weeks, it works as on the free plan until it does.

  • Your videos and files

    The videos you make with the app are yours: you may post them and earn from them, on any plan. Your MIDI files, recordings and videos stay on your computer; the app does not send them to us - so we cannot restore them either: keep your own copies. You are responsible for the rights to the music, MIDI files, recordings and pictures in your video; claims about them are not ours to answer.

  • The piano sound

    The app's piano is the Salamander Grand Piano samples by Alexander Holm, licence CC BY 3.0. If the app's piano sounds in your video, mention the author of the samples in the description.

  • What is not allowed

    You may not sell, rent out or give away the app itself; take its code apart, change it or get around the licence check; remove the mark in any way other than by a subscription - including covering it or cropping it out of a finished video; pass yourself off as us, or use our name and mark as if your video or product were made by us; interfere with the work of the site.

  • Updates and changes to the app

    We keep developing the app: we may add, change and remove features, looks and sounds, and change what it requires of the computer and the system. We do not promise that every version will work on every computer - which is why we advise checking the app on the free plan.

  • If something does not work

    We make the app with care and fix the errors we learn about, but we provide it as it is: we do not promise that there will be no errors at all or that the app will suit every task. We help by email, without promising a response time.

  • The limits of our liability

    We are not liable for indirect losses: lost income, views or subscribers, damaged or lost files, missed deadlines. Nor are we liable for what others decide: the platforms where you post videos, Paddle, Google or your bank. In all other cases our liability is not more than the amount you paid for the subscription in the last 12 months. These terms do not reduce the rights that the law of your country gives you and that cannot be limited.

  • If prices or terms change

    A new price applies only to later renewals, and you will get an email about it in advance, so that you have time to cancel. We may change these terms; we will write about significant changes to those who have a subscription, and the date at the bottom of the page shows when they were last updated. If you keep using the app after a change, you agree to the new terms.

  • If we stop a subscription

    We may stop a subscription without a refund if several people use one account, the licence check is bypassed, these terms are broken or a payment is disputed through the bank. If we stop it for another reason, or close the app altogether, subscriptions will no longer renew, and we will refund the unused paid time.

  • If there is a dispute

    Write to us first at hearclosely@gmail.com - we settle most questions by email. If any point of these terms turns out to be invalid, the rest stays in force.
